Importantly, any ordinance adopted under this new provision will not take effect until the Florida Fish and Wildlife Conservation Commission (the "commission") reviews it and determines, based on substantial evidence, that the restriction is necessary for public safety, with a 90-day timeframe for the commission to act on applications. The bill also mandates that the commission establish criteria and procedures for reviewing these applications and for public notice and participation, and it sets an effective date of July 1, 2026.
