AN ACT to amend the criminal procedure law, in relation to the removal of actions to certain courts in an adjoining county
AI Summary
This bill allows for criminal cases in counties outside of New York City to be moved to a mental health court in an adjoining county, provided the defendant agrees, the district attorney agrees, and the adjoining county's mental health court is designated by the chief administrator of the courts. The mental health court will coordinate with the local governmental unit in the defendant's county of residence for treatment services. Importantly, if the defendant fails to comply with or complete the mental health court program, the case will be sent back to the original court where it started.
