Bill Summary
AN ACT to amend the criminal procedure law, in relation to the removal of actions to certain courts in an adjoining county
AI Summary
This bill allows for criminal cases to be moved from their original court to a mental health court in a neighboring county, provided the defendant agrees and both the district attorney and the district attorney of the adjoining county consent, and the adjoining county's mental health court is designated by the chief administrator of the courts. This process requires the receiving mental health court to work with the local governmental unit in the defendant's county of residence to plan and provide treatment services. Importantly, if the defendant does not follow or finish the mental health court program, the case will be sent back to the original court for further proceedings.
