This bill establishes new regulations for air ambulance membership agreements, which are defined as contracts where a person pays a fee to cover the costs of air ambulance services, but are distinct from health insurance plans regulated under chapter 376. Specifically, it prohibits air ambulance membership organizations from knowingly selling or renewing these memberships to individuals enrolled in MO HealthNet, a state-funded health insurance program for low-income residents. If someone with an existing membership later enrolls in MO HealthNet, they can request a prorated refund or a transfer of the membership to another household member if they notify the organization within thirty days of their MO HealthNet enrollment date. The bill also mandates that all marketing materials and application forms for these memberships clearly disclose that they are not insurance, that MO HealthNet enrollees are ineligible, and that some state laws restrict offering these memberships to Medicaid beneficiaries. Individuals who believe these provisions have been violated can file a complaint with the state attorney general, who will have the authority to investigate and act on such complaints.
