This bill amends existing law concerning access to adjoining property for improvements or repairs by expanding the definition of "state entity" to include any department, division, agency, office, public authority, or public benefit corporation of New York State, along with their affiliates and subsidiaries, and by changing the requirements for insurance documentation provided to the adjoining property owner. Previously, the law required the party accessing the property (the licensee) to procure and maintain commercial general liability insurance, naming the adjoining owner as an additional insured. Now, the bill requires the licensee to provide the adjoining owner and their lessees with relevant documents confirming that the licensee, and any contractors or agents involved, maintain commercial general liability insurance, and importantly, these documents must be sufficient for the adjoining owner or lessees to make a third-party claim if damage occurs to their property or persons on it. This change aims to ensure better protection and recourse for property owners when their neighbors undertake construction or repairs that require access to their land.
