This bill exempts "off-grid electricity providers" from most regulations under the Public Utilities Article, defining such a provider as someone who owns or operates an electric generating facility that is not connected to the state's electric system, does not cross state lines, and is not located on or crossing any federal, state, or local roadway or right-of-way. This exemption applies to providers who begin generating, transmitting, distributing, or selling electricity on or after October 1, 2026, though they must still comply with specific requirements for constructing their facilities related to safety and environmental protection. However, if an entity that initially qualified as an off-grid provider later connects to the state's electric system, crosses state lines, or is located on or crosses a roadway or right-of-way, they will no longer be considered an off-grid provider for the purposes of this exemption.
