This bill exempts certain "off-grid electricity providers," defined as entities that own or operate an electric generating facility that is not connected to the state's electric system, does not cross state lines, and is not located within or crossing any public roadways or rights-of-way, from most regulations under the Public Utilities Article. However, these providers must still comply with specific requirements related to obtaining certificates of public convenience and necessity and other necessary approvals for constructing their generating facilities, as outlined in sections 7-207 and 7-207.1 of the Public Utilities Article. The bill also clarifies that a person will no longer be considered an off-grid electricity provider if their facility later connects to the state's electric system, crosses state lines, or encroaches on public roadways or rights-of-way. This legislation applies to off-grid electricity providers that begin operations on or after October 1, 2026, and the Act itself takes effect on that date.
