Bill Summary

This bill designates kratom as a hallucinogenic schedule I controlled substance. A person possessing kratom is guilty of a serious misdemeanor for a first offense. A person who commits a subsequent violation is guilty of an aggravated misdemeanor. A person who has previously been convicted two or more times is guilty of a class “D” felony. A serious misdemeanor is punishable by confinement for no more than one year and a fine of at least $430 but not more than $2,560. An aggravated misdemeanor is punishable by confinement for no more than two years and a fine of at least $855 but not more than $8,540. A class “D” felony is punishable by confinement for no more than five years and a fine of at least $1,025 but not more than $10,245.

AI Summary

This bill designates kratom, which refers to any part of the plant Mitragyna speciosa and its related compounds like mitragynine and 7-hydroxymitragynine, as a hallucinogenic schedule I controlled substance, meaning it is considered to have a high potential for abuse and no currently accepted medical use. Consequently, possessing kratom will result in penalties that escalate with repeat offenses: a first offense is a serious misdemeanor, punishable by up to one year in jail and fines between $430 and $2,560; a second offense becomes an aggravated misdemeanor, carrying up to two years in jail and fines from $855 to $8,540; and two or more prior convictions elevate the charge to a class "D" felony, with potential imprisonment of up to five years and fines ranging from $1,025 to $10,245.
