This bill designates kratom, which includes the plant Mitragyna speciosa and its synthetic equivalents, as a schedule I controlled substance, meaning it is considered to have a high potential for abuse and no currently accepted medical use in treatment in the United States. Consequently, possessing kratom will result in penalties that escalate with repeat offenses: a first offense is a serious misdemeanor, punishable by up to one year in jail and fines between $430 and $2,560; a second offense becomes an aggravated misdemeanor, with potential jail time up to two years and fines from $855 to $8,540; and two or more prior convictions elevate the charge to a class "D" felony, carrying a maximum of five years in prison and fines between $1,025 and $10,245.
