Bill Summary

At present, N.J.S.A.37:1-3 provides that a marriage or civil union license can be issued by the licensing officer in the municipality in which either party resides or, if neither party is a resident of the State, in the municipality in which the proposed marriage is to be performed. This bill would permit a marriage or civil union license to be obtained in any municipality of this State, as long as the proposed marriage or civil union is to be performed in the State. The bill directs the Commissioner of the Department of Health to adopt and promulgate such rules and regulations as are necessary.

AI Summary

This bill amends existing New Jersey law (N.J.S.A. 37:1-3) to allow individuals to obtain a marriage or civil union license from any municipality within the state, regardless of where they reside, as long as the marriage or civil union ceremony is to take place within New Jersey. Previously, licenses could only be obtained in the municipality where at least one party resided, or if neither party lived in New Jersey, in the municipality where the ceremony was to occur. The bill also mandates that the Commissioner of the Department of Health will establish the necessary rules and regulations to put these changes into effect.
