Bill Summary

This bill provides enhanced penalties for the use of fireworks near an animal shelter, pound, or kennel. Current law prohibits the sale, possession, or use of fireworks, excluding sparkling devices and novelties, other than by an authorized purchaser with a valid permit to purchase fireworks for public display as approved by a municipality. This bill makes it unlawful for any person to use fireworks on a property, public highway, street, road, or alley that is directly adjacent to a property on which is located an animal shelter, pound, or kennel. The bill provides that any person who violates its provisions is guilty of a disorderly persons offense, which is punishable by a term of imprisonment of up to six months or a fine of up to $1,000, or both.

AI Summary

This bill makes it illegal to use fireworks on any property, public highway, street, road, or alley that is directly next to a property housing an animal shelter, pound, or kennel. An animal shelter, pound, or kennel are facilities that house stray or surrendered animals. Violating this new provision is considered a disorderly persons offense, which is a less serious criminal charge, and can result in up to six months in jail, a fine of up to $1,000, or both. The bill also clarifies existing penalties for fireworks violations, designating the use of fireworks as a petty disorderly persons offense and the sale or possession with intent to sell as a fourth-degree crime.
