Bill Summary

This bill provides enhanced penalties for the use of fireworks near an animal shelter, pound, or kennel. Current law prohibits the sale, possession, or use of fireworks, excluding sparkling devices and novelties, other than by an authorized purchaser with a valid permit to purchase fireworks for public display as approved by a municipality. This bill makes it unlawful for any person to use fireworks on a property, public highway, street, road, or alley that is directly adjacent to a property on which is located an animal shelter, pound, or kennel. The bill provides that any person who violates its provisions is guilty of a disorderly persons offense, which is punishable by a term of imprisonment of up to six months or a fine of up to $1,000, or both.

AI Summary

This bill makes it illegal to use, discharge, ignite, fire, or otherwise set off any fireworks on property that is directly next to an animal shelter, pound, or kennel that is licensed by the state. An animal shelter is a place where stray or unwanted animals are housed, a pound is similar to a shelter, and a kennel is a place where animals are boarded or bred. The bill also establishes penalties for violating this new provision, classifying it as a disorderly persons offense, which can result in up to six months in jail, a fine of up to $1,000, or both. This is an enhancement to existing laws that already regulate fireworks, generally prohibiting their sale, possession, and use except for specific exceptions like sparkling devices and novelties, or for authorized purchasers with permits for public displays.
