This bill amends South Dakota Codified Law 44-9-13 to redefine theft by a contractor, subcontractor, or supplier. Previously, theft was defined as knowingly using more than $500 of payment proceeds for purposes other than labor, materials, or machinery contributed to a real estate improvement while outstanding accounts remained unpaid. The revised provision broadens this definition to include any contractor, subcontractor, or supplier who, after receiving or being entrusted with another's property for the purpose of real estate improvement, fraudulently appropriates that property for any purpose other than its intended use for that specific improvement. The bill also clarifies that the penalties for this type of theft will be those outlined in section 22-30A-17.
