This bill enhances the permitting process for high-capacity transit projects by allowing regional transit authorities, which are entities created to manage public transportation systems, to apply for land use and construction permits even before they own the property, provided they notify the property owner. It also permits these authorities to apply for construction permits before a local government makes a land use decision, again with prior notification to the property owner. Furthermore, regional transit authorities can construct rail systems that may exceed local height and setback regulations if they comply as much as practically possible, and the bill clarifies that divisions of land for transit authority acquisitions are exempt from certain subdivision requirements. Importantly, a local government cannot issue permits to a regional transit authority for property not owned by the authority without written permission from the property owner. The bill also modifies rules regarding when a project permit application is considered complete for regional transit authorities, allowing them to submit applications even if they don't yet own the property, as long as other requirements are met. Some provisions of this bill are temporary, with one section expiring in 2028 and another taking effect at that time.
