This bill aims to streamline the permitting process for high-capacity transit projects by granting regional transit authorities, which are public entities responsible for developing and operating public transportation systems, enhanced tools. Specifically, it allows these authorities to apply for land use and construction permits even before they own the property, provided the current owner is notified, and to apply for construction permits before a final land-use decision is made, again with owner notification. The bill also permits transit authorities to build rail systems that may exceed local height and setback regulations if they comply to the extent practicable, and it clarifies that local governments must accept permit applications from regional transit authorities even if the authority does not yet own or possess the property, as long as the application is otherwise complete. Furthermore, it exempts land divisions caused by a regional transit authority acquiring property for facilities from certain subdivision requirements. Some provisions of this bill are set to expire on January 1, 2028, while others will take effect on that date.
