Bill Summary

This bill relates to matters under the purview of the department of inspections, appeals, and licensing. The bill is organized in divisions. DIVISION I —— GAMBLING. The bill eliminates a $30,000-per-year total cap on reimbursements that the state racing and gaming commission (commission) may pay to all commissioners for expenses incurred in the performance of the commissioners’ duties. The bill grants the commission explicit authority to issue cease and desist orders and seek injunctive S.F. _____ H.F. _____ relief against persons who offer gambling services in the state without an appropriate license or authorization. Under current law, a person commits a class “D” felony and is barred for life from excursion gambling boats and gambling structures under the jurisdiction of the commission for committing certain acts listed in Code section 99F.15(4). The bill expands the lifetime ban to include sports wagering and advance deposit sports wagering. The bill also imposes a lifetime ban from sports wagering and advance deposit sports wagering on a person who is convicted twice of unlawful betting. DIVISION II —— STATE BUILDING CODE. The bill requires the state building code commissioner to consult with the department of homeland security and emergency management, instead of the department of public defense, in adopting rules relating to safe rooms and storm shelters. The bill also requires fees collected by the state building code commissioner to be deposited in the licensing and regulation fund instead of the general fund of the state. DIVISION III —— RESIDENTIAL CARE FACILITIES. The bill allows a residential care facility that is a pediatric palliative care center to serve as few as zero individuals. Under current law, an entity must serve at least three individuals to be defined as a residential care facility.

AI Summary

This Study Bill proposes several changes across different areas regulated by the Department of Inspections, Appeals, and Licensing. Firstly, it modifies gambling regulations by removing an annual cap on reimbursements for state racing and gaming commission members and explicitly granting the commission the power to issue cease and desist orders and seek court injunctions against unlicensed gambling operations, while also expanding lifetime bans from gambling activities to include sports wagering for those convicted of certain offenses. Secondly, concerning the state building code, the bill shifts the consultation requirement for safe room and storm shelter rules from the Department of Public Defense to the Department of Homeland Security and Emergency Management, and directs fees collected by the building code commissioner to a specific licensing and regulation fund instead of the general state treasury. Finally, the bill revises the definition of a residential care facility by allowing those designated as pediatric palliative care centers to serve as few as zero individuals, removing the previous minimum requirement of three residents.
