This bill expands the definition of identity theft in Hawaii to include fraudulent impersonation or false depiction through artificial intelligence (AI), which is defined as a machine-based system that makes predictions or decisions influencing real or virtual environments, or materially deceptive media, which is any information like video, images, or audio that falsely depicts an individual engaging in speech or conduct they did not, and would reasonably lead a viewer or listener to believe it was real, and was created using AI or digital technology. These additions are incorporated into the existing offenses of identity theft in the first, second, and third degrees, specifically when the intent is to gain access to confidential information or accounts to commit theft, or to facilitate the commission of certain serious crimes.
