This bill expands the definition of identity theft in Hawaii to include fraudulent impersonation or false depiction created using artificial intelligence (AI) or materially deceptive media. Artificial intelligence is defined as a machine system that can make predictions or decisions based on inputs and analysis of real or virtual environments. Materially deceptive media refers to any audio, video, or image that falsely depicts an individual engaging in speech or conduct they did not, and which would reasonably lead a viewer or listener to believe it was real, and was created using AI, digital technology, or similar advanced techniques. These new provisions are added to the existing laws concerning identity theft in the first, second, and third degrees, clarifying that using these technologies to impersonate someone or create false depictions with the intent to commit theft or gain access to confidential information constitutes identity theft.
