This bill amends Tennessee law regarding the defense of property by lowering the standard for when a person can use deadly force, which is force likely to cause death or serious bodily injury. Previously, the law allowed deadly force to protect property only if lesser force would expose the person or a third party to a risk of death or serious bodily injury. This bill now permits the use of deadly force if a person reasonably believes it is immediately necessary to prevent or stop certain property crimes like trespass, arson, damage to property, burglary, theft, robbery, or aggravated cruelty to animals, and also reasonably believes that the property cannot be protected or the actions stopped by any other means, or that using less than deadly force would put them or someone else at risk of death or serious bodily injury. However, the bill specifies that deadly force is not justified if the individual against whom it is used is facing away from the person.
