This bill modifies the process for registering births involving surrogate mothers by adding a new requirement before a court can determine parental rights. Currently, if a child is born to a surrogate mother, her information is recorded on the birth certificate, and the father's information is omitted. If a court later decides who the parents are, the court clerk informs the state registrar, who then creates a new birth record and instructs the local registrar to destroy the original. Under this bill, a court will be prohibited from determining parental rights for a child born via surrogacy, unless the case involves an adoption, or at least one person seeking parental rights is biologically related to the child.
