Under current law, if a child is born to a surrogate mother, information about the surrogate mother must be entered on the child’s birth record and information about the father must be omitted from the birth record. If a court determines parental rights over the child, the clerk of court must report the court’s determination to the state registrar, who must prepare and register a new birth record and send notice to the local registrar who filed the original record to have the replaced record destroyed. Under this bill, a court may not determine parental rights over a child born to a surrogate mother unless at least one individual petitioning for parental rights is biologically related to the child.
