This bill mandates the Division of Emergency Management (DEM) to create emergency operations plans (EOPs) for dams classified as high-hazard potential, meaning they pose a significant risk to life and property if they fail. These EOPs, which are detailed plans for responding to emergencies, must be completed by specific deadlines based on the number of people living or working in the area that could be flooded if the dam breaks, with more populated areas having earlier deadlines. The DEM will coordinate with dam owners, local officials, and emergency responders to ensure these plans are sufficient to protect the public, including identifying alternative routes for emergency services if roads are flooded. The bill also clarifies that the Governor or the Director of Emergency Management can order evacuations without local government approval if a dam fails or is at imminent risk of failure, overriding a previous requirement for municipal consent in such situations. Furthermore, the DEM will conduct a pilot project to develop EOPs for two state-owned high-hazard dams with over 1,000 people at risk, and will report on the results, costs, and recommendations for future dam safety planning.
