This bill clarifies that while a court can require participation in the 24/7 sobriety program as a condition of bond or pre-trial release, a defendant cannot be jailed or have their release revoked solely for failing to pay the program's costs and expenses unless the court determines they have the ability to pay. The defendant bears the responsibility of proving they did not willfully fail to pay or made a genuine effort to do so. Any unpaid program costs can be imposed by the court at the end of the criminal case if the defendant is found to have the financial capacity to cover them.
