Currently, insurance for individuals driving a vehicle they are permitted to use from a business that sells, repairs, leases, or services vehicles is considered primary, meaning their personal insurance must be exhausted before the business's insurance is accessed. This bill changes that priority, making the business's insurance primary for certain situations, such as when an employee is operating a vehicle for the business or when a vehicle is being tested for purchase or a lease longer than thirty days. The bill also clarifies that security maintained by businesses that rent, lease, sell, repair, or service vehicles is secondary to an individual's available motor vehicle liability insurance, unless specific additional consideration was paid for primary coverage from the rental or leasing company.
