This concurrent resolution declares that the rules and regulations proposed by the New Jersey Department of Environmental Protection (DEP) called "New Jersey Protecting Against Climate Change - Resilient Environment and Landscapes" (NJPACT - REAL) are not in line with what the Legislature intended when passing laws. The Legislature believes the DEP has overstepped its authority by creating these rules, which would significantly impact residents, especially in coastal areas, by increasing costs for building and potentially raising property taxes. The DEP is given 30 days from the resolution's official transmission to either change or withdraw these proposed rules; if they do not, the Legislature can pass another resolution to officially block the rules. The DEP's justification for these rules, based on existing laws, is questioned by the Legislature, which argues that some cited laws are too old to have anticipated climate change issues or have been repealed, and that the DEP did not properly cite the relevant climate change law, the "Global Warming Response Act," which limits the DEP's authority to greenhouse gas monitoring and reporting.
