Bill Summary

This bill provides that no otherwise eligible individual shall be denied unemployment benefits for any week in which the individual is regarded as having left work voluntarily and without good cause attributable to the work, if the Department of Labor and Workforce Development determines that the individual was unavailable that week for work solely because the individual was being detained for charges which were subsequently dismissed by a decision not to prosecute, a decision of a grand jury not to indict, or a finding of not guilty after a trial. No employer's account is to be charged for the payment of benefits paid under those circumstances.

AI Summary

This bill amends existing unemployment benefit laws to ensure that individuals are not denied benefits if they are unavailable for work solely because they were detained on charges that were later dismissed, either by a decision not to prosecute, a grand jury's decision not to indict, or a not guilty verdict after a trial. This means that if someone is unable to work due to being arrested and subsequently cleared of all charges, they will still be eligible for unemployment benefits for that period, even if they would normally be disqualified for voluntarily leaving work without good cause. Importantly, employers' accounts will not be charged for any benefits paid out under these specific circumstances.
