This bill allows partnerships and joint ventures to bid on "heavy infrastructure projects," which are defined as public works projects involving the planning, design, construction, or maintenance of essential facilities and systems like roads, bridges, transit systems, and utilities. Previously, only individually registered contractors could bid on such public works and prevailing wage contracts. Under this new legislation, a partnership or joint venture can bid if every individual party within it is independently registered. Before being awarded a contract, the partnership or joint venture must register with the Department of Labor and Workforce Development, obtain a Public Works Contractor Registration certificate, and appoint a primary contract manager. Importantly, all parties in the partnership or joint venture will be held jointly and severally liable for any contract failures or non-compliance, meaning any party can be held responsible for the actions of another, and such failures could lead to penalties, including contract cancellation.
