Bill Summary
This bill permits the detention by State law enforcement agencies of persons in this State illegally to facilitate transfer to federal immigration authorities, regardless of the nature, degree, and severity of the offense with which the person is charged. In addition, the bill provides compensation to State law enforcement agencies directly involved in the deportation. Under the bill, for every person determined to be in this State illegally who is successfully deported, any State law enforcement agency directly involved in the process that led to the deportation of the person will be eligible to receive a compensation payment of $7,000 from the State. In the event that more than one law enforcement agency is directly involved in the deportation process, compensation is to be allocated proportionately based on each agency's level of involvement as determined by the Attorney General. The bill provides that a law enforcement agency will be considered directly involved in the deportation process if it has detained a person in order to facilitate transfer to federal authorities. Under the bill, the Attorney General is required to establish rules and regulations for determining eligibility and awarding compensation to participating law enforcement agencies.
