Bill Summary
This bill revises the registered apprenticeship program requisites of public works contractors. Specifically, the bill creates an opt-out for contractors from the apprenticeship requirements under "The Public Works Contractor Registration Act" in exchange for the payment of an annual fee. The bill provides that the classroom, on-the-job hours, and years of apprenticeship required to meet the industry standards for apprenticeship program completion shall be equal to or greater than that of the apprenticeship standards of the building and construction trade union that is specific to each craft. The apprenticeship standards will be detailed in the wage determinations for each craft. The bill removes requirements in current law that provide that apprentices shall receive, for each year of the program, at least 2,000 hours of on-the-job training and at least 144 hours of related classroom instruction. The registered apprenticeship program will include the establishment of an "ERISA-covered apprenticeship training program trust fund." Under the bill, "ERISA-covered apprenticeship training program trust fund" means an "employee welfare benefit plan," as that term is defined within the Employee Retirement Income Security Act of 1974 (ERISA), that is subject to the requirements for that kind of plan under ERISA, and that is a fund established and maintained for the sole purpose of financing a registered apprenticeship program. Finally, the bill repeals the provision of "The Public Works Contractor Registration Act" that exempts subcontractors of contractors from being required to register under that law if they do not perform work at any construction site subject to that law.
AI Summary
This bill revises requirements for public works contractors regarding registered apprenticeship programs, allowing contractors to opt-out of these requirements for each craft they employ by paying an annual fee of $1,000 per craft. Funds collected from these opt-out fees will be split, with 50% going to the Department of Labor and Workforce Development to support apprenticeship recruitment and programs in underserved communities, and the other 50% going to the New Jersey Economic Development Authority for micro-grants to help female, minority, and veteran-owned construction firms grow. The bill also modifies the standards for registered apprenticeship programs, stipulating that the required on-the-job hours, classroom instruction, and program duration must be equal to or greater than the standards set by specific building and construction trade unions for each craft, with these standards to be detailed in wage determinations. Furthermore, it mandates that registered apprenticeship programs include an "ERISA-covered apprenticeship training program trust fund," which is defined as a fund established and maintained solely to finance a registered apprenticeship program and is subject to the Employee Retirement Income Security Act of 1974 (ERISA). Finally, the bill repeals a provision that exempted subcontractors from registration requirements if they did not perform work on sites subject to the law.
