Bill Summary

This bill amends the "Spill Compensation and Control Act," P.L.1976, c.141 (C.58:10-23.11 et seq.), to require, if a settlement addresses natural resource damages, that a website link to the applicable natural resource damage assessment report and natural resource damage restoration plans and projects be made available in the New Jersey Register and on the New Jersey Department of Environmental Protection's website. Existing law already requires, at least 60 days prior to its agreement to any administrative or judicially approved settlement, the Department of Environmental Protection to publish the name of the case, the names of the parties to the settlement, the location of the property on which the discharge occurred, a summary of the terms of the settlement, including the amount of any monetary payments made or to be made.

AI Summary

This bill requires the New Jersey Department of Environmental Protection (DEP) to make additional information publicly available when it settles cases related to spills under the "Spill Compensation and Control Act," which is a law designed to address and clean up hazardous substance discharges. Specifically, if a settlement involves "natural resource damages" – meaning compensation for harm done to natural resources like water, soil, or wildlife – the DEP must now provide a link to the relevant reports detailing the assessment of these damages and any plans or projects for restoring those resources. This information will be accessible through the New Jersey Register, the official publication for government notices, and on the DEP's own website, in addition to the existing requirements of publishing case names, party names, property locations, and settlement terms, including monetary payments.
