Bill Summary
An Act to authorize counties and municipalities to issue a license for a cigar bar.
AI Summary
This bill allows counties and municipalities to issue licenses for cigar bars, which are establishments where people can smoke cigars. Counties can approve one cigar bar license outside of city limits within their jurisdiction, while cities can approve one license within their limits and an additional one for every 25,000 residents, with existing establishments under a specific law not counting towards this limit. To get a license, an establishment must have a humidor, be enclosed with solid walls, a ceiling, and a door, have a proper ventilation system, be approved for certain types of alcohol licenses (subdivisions 35-4-2(4), (6), (12), or (16)), and generate at least ten percent of its income from selling cigars, defined as a tobacco roll with a wrapper of only tobacco, a ring gauge of forty or greater, and sold without a filter. These cigar bars are exempt from certain smoking restrictions, but can only permit the smoking of cigars purchased on-site, not other tobacco products, and must post a notice of this prohibition. Licensees must also report their cigar income annually to the Department of Revenue. Licenses can be revoked or suspended after a public hearing if the establishment fails to meet requirements, violates the law, or breaks local tobacco ordinances, and licensees cannot sell or transfer their licenses.
