This bill amends West Virginia Code §17-4-17b to allow the Division of Highways (DOH), at its discretion, to provide partial or full reimbursement to public utilities for the timely relocation of their lines or facilities when required for highway construction projects. This new provision, labeled as subsection (g), allows the DOH to offer reimbursement if a utility successfully completes the physical relocation by a deadline set by the DOH. For a utility to be eligible, the DOH must first notify them in writing about their eligibility for reimbursement, the specific deadline for completion, the percentage or amount of reimbursement offered, and any other requirements. Any reimbursement must be agreed upon in a written agreement between the DOH and the utility before the relocation work begins, and this provision does not affect a utility's right to compensation if their existing location is on property they own or have a legal right to occupy.
