AN ACT to amend the election law, in relation to requiring disclosure of major contributors on independent expenditure communications

This bill requires that any individual, entity, or political committee making an "independent expenditure" (defined as a communication that advocates for or against a candidate or ballot proposal, or refers to one, within sixty days of an election, and is not coordinated with a candidate's campaign) on various media, including direct mail, internet, radio, and television, must prominently display a disclaimer. This disclaimer must state who paid for the communication and that it was not made in cooperation with any candidate. If the spender received over $1,000 from any single contributor in the preceding twelve months, the disclaimer must also list the top three largest contributors who gave over $1,000, in descending order. If the spender has a treasurer, their name must also be included. The disclosure must be easily readable or audible for at least four seconds and include a web address for state election disclosures. This requirement does not apply to candidates under the jurisdiction of the New York City Campaign Finance Board. The bill also clarifies that only contributions earmarked for, solicited for, or reasonably expected to support independent expenditures count towards the "top contributor" disclosure, and directs the State Board of Elections to create standardized formats for these disclosures.
