This bill allows local governments, referred to as "political subdivisions" (like counties or cities), to enter into agreements with developers of new private construction projects to share the costs of necessary public infrastructure improvements that extend beyond the development's property boundaries. These "offsite public infrastructure improvements" can include roads, utilities like water and broadband, and other public services. If a local government determines such an improvement is needed to support a new development, they can require the developer to contribute to its construction or cost, based on how much the development will use or impact the infrastructure. The local government has 60 days to make this determination. If the developer and the local government cannot agree on the cost-sharing amount, the developer can ask the Tennessee Board of Utility Regulation to decide. The local government's portion of the cost can be funded through impact fees from other developments, bond money, or existing tax revenues.
