This bill prohibits the distribution of "electoral deepfakes," which are deceptive and fraudulent manipulated media (like images, audio, or video) that falsely depict a candidate or political party, within 90 days of an election, if the distributor knew or should have known it was deceptive. An electoral deepfake is defined as something that appears to show a real person saying or doing something they didn't, or gives a fundamentally different impression than the original media. This prohibition does not apply if the manipulated media includes a clear disclosure stating it has been manipulated or generated by artificial intelligence, with specific requirements for how and when this disclosure must appear depending on the type of media. Candidates or political parties harmed by such deepfakes can seek court orders to stop their publication, and violators can face civil penalties ranging from $1,000 to $10,000 depending on the severity and prior offenses. The bill includes exceptions for bona fide news reporting, paid broadcasts where good faith efforts were made to verify authenticity, and publications that clearly state the deepfake is not accurate, as well as for satire or parody.
