This bill enacts the "Tennessee Secondary Aluminum Waste Management Act," which aims to regulate the disposal of waste generated from secondary aluminum smelting operations. The Act defines "secondary aluminum waste" as materials like aluminum dross, salt cake, and baghouse dust that are byproducts of recycling aluminum. Key provisions prohibit mixing this specialized waste with regular municipal solid waste in landfills. Instead, secondary aluminum waste can only be disposed of in designated landfill areas, known as "dedicated units" or "monofills/monocells," which must be specifically permitted for this purpose. Furthermore, the bill prevents the addition of any waste, including secondary aluminum waste or municipal solid waste, on top of previously filled or closed dedicated units. The Department of Environment and Conservation is tasked with creating rules to implement these requirements, including setting standards for permitting these dedicated units, ensuring protection of human health and the environment, and establishing operational criteria such as liner design and leachate control. The rules will be developed following the Uniform Administrative Procedures Act. The bill takes effect for rule-making purposes immediately upon becoming law, but its main provisions regarding waste disposal will apply starting July 1, 2026.
