This bill enacts the "Tennessee Secondary Aluminum Waste Management Act," which establishes specific regulations for the disposal of secondary aluminum waste, defined as waste materials containing aluminum generated from secondary aluminum smelting operations, such as dross, salt cake, baghouse dust, or dry-milled wastes. The Act prohibits mixing municipal solid waste with this secondary aluminum waste. While secondary aluminum waste can be disposed of in landfills, it must be placed in a dedicated unit, like a monofill or monocell, specifically permitted for this purpose. Furthermore, no waste, including secondary aluminum waste or municipal solid waste, can be added on top of previously filled or closed dedicated units containing secondary aluminum waste. The Department of Environment and Conservation (Department) is tasked with creating rules to implement these provisions, including criteria for permitting dedicated units, performance standards for environmental protection, and operational guidelines, considering factors like liner design and leachate control. The rules will be developed according to the Uniform Administrative Procedures Act. The Act takes effect for rule promulgation immediately upon becoming law, and for all other purposes, it becomes effective on July 1, 2026, applying to waste disposed of on or after that date.
