This bill, effective July 1, 2026, prohibits any county, municipality, or other local government in Tennessee (referred to as an "exporting jurisdiction") from sending solid waste to a landfill located outside its own borders unless the local government where the landfill is physically located (the "host county" or "host municipality") has formally agreed to accept it through a "host community agreement." This agreement must be a written contract detailing terms like the duration, specific landfill, any payments or fees to the host community, and rules for truck routes, operating hours, environmental protections, and enforcement, all approved in a public meeting. The state department responsible for permits will not issue or renew permits for landfills accepting waste from outside their jurisdiction without proof of a compliant host community agreement. This rule does not apply to existing contracts in place before July 1, 2026, or to waste disposal during emergencies declared by the governor or commissioner, and it doesn't prevent host communities from imposing their own additional conditions.
