This bill, effective July 1, 2026, requires that any county, municipality, or other local government (referred to as an "exporting jurisdiction") that wants to send its solid waste to a landfill outside its own borders must first obtain a written agreement from the local government where the landfill is located (the "host county" or "host municipality"). This agreement, called a "host community agreement," must be approved by both governments and will outline details such as the agreement's duration, the specific landfill involved, any payments or fees to the host community, and rules regarding truck routes, operating hours, and environmental protections. The state department responsible for permits will not allow landfills to accept waste from outside their jurisdiction unless this agreement is in place and meets the bill's requirements. Existing contracts for waste disposal entered into before July 1, 2026, are exempt until they expire or are renewed, and the bill also allows for exceptions in declared emergencies. This legislation aims to give host communities more control and input when their areas are used for solid waste disposal from other jurisdictions.
