This bill establishes requirements for delivery network companies (DNCs), which are businesses that use a digital network to connect customers with drivers for delivery services, and for DNC drivers who use their personal vehicles for these deliveries. Key provisions include mandating that DNCs ensure primary automobile liability insurance is in place during both the "delivery availability period" (when a driver is logged in and available but not actively delivering) and the "delivery service period" (when a driver is en route to pick up or is transporting goods for delivery). This insurance must cover at least $50,000 for bodily injury per person, $100,000 for bodily injury per accident, and $25,000 for property damage per accident, and can be met by the driver's insurance, the DNC's insurance, or a combination. If a driver's insurance lapses, the DNC's insurance must cover claims from the first dollar, and DNCs must cooperate with insurers by providing precise times of driver activity around accidents. The bill also clarifies that personal auto insurance policies may exclude coverage during these delivery periods and requires DNCs to disclose their insurance coverage and limits to drivers, informing them that their own policies might not cover them while working.
