This bill, amending the Elliott-Larsen Civil Rights Act, prohibits employers from entering into agreements that prevent employees or former employees from disclosing violations or suspected violations of the act, or facts related to them. However, employers can enter into such agreements if they provide written notice to the employee about this prohibition and their right to consult an attorney for at least five business days before signing, and if the employee is not represented by an attorney, they are given the same five-day period to retain one. Additionally, the agreement must release the employee's claim regarding a violation of the act and be otherwise legally valid. Any agreement violating these provisions will be considered void, and this rule applies to agreements made, changed, extended, or renewed on or after the bill's effective date.
