This bill amends the Elliott-Larsen Civil Rights Act, a Michigan law that prohibits discrimination based on sex and other protected characteristics, by adding a new section that addresses confidentiality in settlement agreements. Specifically, it prohibits settlement agreements related to claims of assault, discrimination, harassment, or retaliation based on sex from including provisions that prevent or restrict the disclosure of factual information about the claim, unless certain exceptions apply. These exceptions allow for the claimant's identity and any facts that could reveal it to be kept confidential at the claimant's request, provided a government agency or public official is not a party to the agreement, and also permit the amount paid in settlement to remain confidential. Any provision in a settlement agreement that violates these new rules is declared void and against public policy.
