This bill, the Uniform Community Property Disposition at Death Act, clarifies which property held by a community property spouse is subject to the act, regardless of whether the decedent was domiciled in Colorado at the time of death. Specifically, it now applies to real property located in Colorado that can be traced to community property or acquired with community property under the laws of the jurisdiction where the decedent or surviving spouse was domiciled when the property was acquired or later became community property, as well as any income, rent, profit, appreciation, or other increase derived from or traceable to such real property. This expands the act's reach beyond just personal property traceable to community property acquired while domiciled in Colorado.
