This bill requires each public senior higher education institution, which includes the constituent institutions of the University System of Maryland, Morgan State University, and St. Mary's College of Maryland (but excludes the University of Maryland Center for Environmental Science and the University of Maryland Global Campus), and each community college to submit an annual report to the Maryland Higher Education Commission detailing how students are provided access to over-the-counter contraception, which refers to any contraceptive drug or device approved by the U.S. Food and Drug Administration that can be obtained without a prescription. These reports, due by September 1st each year starting in 2026, must also include information on whether all available methods of over-the-counter contraception are provided, the quantity distributed, and how students and student organizations were consulted in the process. Subsequently, the Maryland Higher Education Commission must compile this information and submit its own report to the General Assembly by October 1st each year, beginning in 2026. Additionally, the bill mandates that each community college must ensure students have access to all methods of over-the-counter contraception through various means, such as student health centers, on-campus retail, vending machines, or other accessible methods, with a plan to be developed and implemented by August 1, 2025.
