This bill requires each public senior higher education institution, which includes the constituent institutions of the University System of Maryland, Morgan State University, and St. Mary's College of Maryland (but excludes the University of Maryland Center for Environmental Science and the University of Maryland Global Campus), and each community college to report annually to the Maryland Higher Education Commission (MHEC) on how they provide students with access to over-the-counter contraception, defined as any contraceptive drug or device approved by the Federal Food and Drug Administration that can be obtained without a prescription. These reports, due by September 1st each year starting in 2026, must detail the methods of access, whether all available over-the-counter contraception methods are provided, the amount of contraception distributed by method, and how students and student organizations were consulted. MHEC will then compile this information into an annual report to the General Assembly, beginning October 1, 2026. Additionally, this bill mandates that each community college must ensure students have access to all methods of over-the-counter contraception through various means, such as student health centers, campus retail establishments, or vending machines, by August 1, 2025, and the Maryland Department of Health may offer assistance in developing these plans.
