This bill establishes a new "Class 10 Farm Distillery License" that allows holders of a "Class 8 Farm Brewery License" (a license for breweries located on farms) to distill, rectify, bottle, and sell distilled spirits produced on their farm, either wholesale or retail. To qualify for either license, the farm must be an agribusiness involved in producing and showcasing farm products and actively engage in agritourism, which means exposing the public to farming practices. The bill also modifies requirements for food service at these farm establishments, allowing them to sell or serve food if they are licensed as a food establishment, use a licensed food truck or caterer, or sell "cottage industry food" prepared on the farm. Additionally, it permits both Class 8 Farm Breweries and the new Class 10 Farm Distilleries to host festivals, provide entertainment, and rent out portions of their farms for events. The bill also clarifies that the Commission has exclusive regulatory authority over these farm-based alcohol production licenses and sets an annual license fee not exceeding $500 for Class 10 Farm Distilleries.
