This bill prohibits individuals appointed to a county board of education, meaning those appointed by a government official or body and not elected or appointed to fill a vacancy for an elected position, from serving as president, vice president, chair, or vice chair of that board. If a county board allows an appointed member to hold such a leadership position after July 1, 2026, the State Department of Education will notify the board and require immediate correction. If the board fails to remove the appointed member from the leadership role within 30 days, the Department can suspend administrative funding and require the board to post notice of the violation on its website. If the violation continues for 60 days, the Department may withhold further funding and refer the matter to the Attorney General for enforcement, and may also impose a civil penalty of up to $2,500 on the appointed member who knowingly and willfully remains in the leadership position.
