This bill establishes a deicer applicators registration program managed by the Department of Agriculture, Trade and Consumer Protection (DATCP) to train commercial applicators, defined as individuals who apply deicer for hire but not government employees, in methods that protect water quality when removing snow and ice. DATCP will certify training providers and register commercial applicators who complete approved training and pass an exam, with registrations valid for five years, and will maintain a public list of registered applicators. Importantly, a registered commercial applicator and the owner of private property who hires one are presumed not liable for damages from snow and ice hazards on that property if the hazard is solely due to snow or ice and the applicator used approved methods, though this protection does not extend to reckless or intentional misconduct. Registered applicators must maintain records of their training, exams, maintenance practices, deicer usage, and submit annual reports on deicer amounts used, and their registration can be revoked by DATCP for non-compliance, with a right to a hearing.
