This bill establishes a deicer applicators registration program, requiring the Department of Agriculture, Trade and Consumer Protection (DATCP) to create a system for training and registering commercial applicators who apply deicers, which are substances used to melt snow and ice on privately owned surfaces. The program aims to ensure these applicators are trained in methods that protect water quality, and upon successful completion of approved training and passing an exam, individuals will become registered commercial applicators. A key provision offers a presumption of no liability for registered commercial applicators and the owners of private property who contract with them, for damages arising from snow and ice accumulation hazards on that property, provided the registered applicator used the approved training methods and the hazard was solely due to snow or ice. This protection does not apply if the applicator or owner engages in reckless or intentional misconduct, intentionally injures someone, or fails to use the approved snow and ice removal methods. Registered applicators will also be required to maintain records of their practices and report their deicer usage annually, and their registration can be revoked for non-compliance.
