Bill Summary

This bill authorizes certain fire police units to appoint fire police officers, and permits a notary public to administer an oath to a fire police officer. Currently, a volunteer fire company may appoint a member of the company as a fire police officer. Under the provisions of this bill, a fire police unit that is incorporated, has filed appropriate tax forms, insures all members, and has a designated station number may appoint a person who is not a member of the company as a fire police officer if the person is of good health and good moral character, and has not been convicted of a crime involving moral turpitude. An officer appointed by a unit will comply with the same requirements and will have the same duties as officers appointed by a volunteer fire company. Current law requires the municipal clerk to administer the oath to volunteer firefighters who perform police duties. Under provisions of this bill, a notary public also may administer an officer's oath.

AI Summary

This bill expands the ability of fire police units to appoint fire police officers and allows for a notary public to administer their oaths. Currently, only volunteer fire companies can appoint their own members as fire police officers, who are responsible for duties like establishing fire lines and directing traffic at fires. Under this bill, incorporated fire police units that have filed tax forms, insure their members, and have a designated station number can now appoint individuals who are not members of a volunteer fire company, provided these individuals are healthy, of good moral character, and have no criminal convictions involving moral turpitude, which refers to acts that are inherently base or depraved and contrary to the accepted rules of morality and duties owed to society. These newly appointed fire police officers will have the same duties and requirements as those appointed by volunteer fire companies. Additionally, the bill allows a notary public, in addition to the municipal clerk, to administer the oath of office to these fire police officers, which is a formal declaration to faithfully perform their duties.
